LAWA & Balance by Nature Liability Waiver

By registering for these events, I agree to the following:
I, _______________________________________, hereby agree to the following:

1. That I am voluntarily participating in the fitness, meditation, massage, nutrition, and/or other wellness classes (“Wellness Classes”) offered by Balance by Nature, LLC, during which I will receive information and instruction. I recognize that Wellness Classes (specifically fitness and massage) require physical exertion that may be strenuous and may cause physical injury, and further that my participating in any of these Wellness Classes may expose me to inherent risks, including accidents, injury, or illness. I am fully aware that physical activity, by its very nature, carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries.

2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Wellness Classes. I represent and warrant that I am physically able to fully participate in the Wellness Classes. I acknowledge that it is my responsibility to communicate any physical or psychological concerns that I have which might conflict with my ability to fully participate in the Wellness Classes.

3. Assumption of Risks: In consideration of being permitted to participate in Wellness Classes, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in any such Class.

4. Waiver: In further consideration of being permitted to participate in Wellness Classes, I knowingly, voluntarily and expressly waive, release and discharge, any claim that I, for myself, my heirs, personal representatives or assigns may have against Balance by Nature, LLC and/or the City of Los Angeles, including its Department of Airports, also known as Los Angeles World Airports or their respective officers, managers, Board of Airport Commissioners, City council members, directors, business associates, employees and agents for injury or damages that I may sustain as a result of participating in any of the Wellness Classes.

5. Indemnification and Hold Harmless: I agree to hold harmless and indemnify Balance by Nature, LLC and the City of Los Angeles, including its Department of Airports, also known as Los Angeles World Airports from all claims, actions, suits, procedures, costs, expenses, damages and liability, including attorneys fees incurred, and to reimburse them for any such or further expense incurred by Balance by Nature, LLC or the City of Los Angeles, including its Department of Airports, also known as Los Angeles World Airports in investigating and defending a claim or suit brought by me, my heirs, personal representatives or assigns.

6. Voluntary Activity: I agree that my choice to participate in the Wellness Classes is voluntary and that I am not doing so as an employee or representative of the City of Los Angeles, including its Department of Airports, also known as Los Angeles World Airports, and that my participation is limited to my personal time that is not compensated. I further agree that my participation in Wellness Classes is not a requirement of my employment and that my employer has no expectation whatsoever that I will participate.

7. Disclaimer: Please be advised that LAWA is not obligated for payment of workers’ compensation benefits to employees injured as a result of participating in the Wellness Classes. Any injury to an employee which occurs during an off-duty recreational, social, athletic, charitable, or fundraising activity is not covered by LAWA’s worker’s compensation program. 8. Severability: Finally, I agree that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the laws of the State of California, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I have read the above release, waiver of liability, assumption of risk and indemnity agreement, fully understand and freely and voluntarily agree to its terms and conditions, knowing that I am giving up substantial rights, including my right to sue.
